Terms and conditions Kledingkleuradvies
Version 2026-09. These terms apply to every order of a colour advice placed through the Kledingkleuradvies website. This is an English translation of our Dutch "Algemene voorwaarden"; if the two differ, the Dutch text prevails.
1. Who we are
Kledingkleuradvies is a service of Beste Prijs, Schapendreef 455, 3034 ZM Rotterdam, registered with the Dutch Chamber of Commerce (KVK) under number 74982591, VAT identification number NL002305178B25. You can reach us at advies@kledingkleuradvies.nl. We reply within 1 working day.
In these terms "we" and "us" means Beste Prijs; "you" means you, the customer.
2. When these terms apply
- These terms apply to every order you place with us and to everything we do for you afterwards.
- You order as a consumer: for yourself, not for a business or profession. If you are a business and want to use our advice commercially, please contact us first.
- You must be 16 or older to order. You confirm this when ordering.
- If any clause of these terms turns out to be invalid, the rest remains in force. We will replace the invalid clause with a valid one that comes as close as possible to it.
3. What you buy
- You buy a personal colour advice for clothing: a report (PDF) with your colour profile on four axes (warm–cool, muted–clear, light–deep and contrast), a colour palette in groups, comparison images of your own five tops and a colour card for your phone. Optionally you add a wardrobe check: an assessment of clothes in your own photos.
- How it works: you upload a fixed set of photos with a white piece of paper in frame. Our software uses that paper to correct the light and measures the colours of your skin, eyes and hair. An AI system checks your photos as you upload them and helps draft the text. After that our colour expert, a person, looks at every advice before we send it. No advice leaves without that check.
- The advice is an indication based on your photos. It is not a guarantee that a colour will suit you in real life: light, fabric, sheen, print and your own taste matter too. Use the advice as a tool for choosing, not as a rule.
- The advice is about clothing colours. It is not medical, dermatological or other health advice and says nothing about your health.
- You do not need an account. Everything runs from a link we send to your e-mail address. Keep that link to yourself: anyone who has it can see and edit your order.
4. Photos: what we ask and what is your responsibility
- You upload the photos the website asks for: close-ups of one eye and of the inside of your wrist, face photos (outdoors and indoors), a side view, your hair and five photos in differently coloured tops. Every photo (except the wardrobe photos) must show a sheet of white paper. The website explains how to take each one.
- You are responsible for the photos. That means: - they are photos of you, and you are the only person in them; - you took them yourself or are allowed to use them; - they are recent, without filters, without beauty mode and with as little make-up as possible; - they were taken in daylight, as the instructions ask.
- Our software checks every photo straight after upload. If you get a warning and still choose "use anyway", you accept that the advice may be less precise as a result. We cannot use a photo without white paper or with more than one person in it.
- After payment you can no longer change your photos or answers. Please check them before you pay.
- If our colour expert decides after payment that your photos are not usable after all, article 9 applies.
5. Price and payment
- All prices on the website are in euros and include VAT. The price you see just before paying is the price you pay. There are no extra charges.
- You pay in advance through our payment provider Mollie B.V., using the payment methods offered at checkout (for example iDEAL, Bancontact or credit card). Mollie processes your payment details; we never see your account or card number.
- Your order is final once Mollie confirms the payment to us. You then receive an e-mail with a simplified invoice.
- If you accidentally pay twice for the same order, we refund the second payment automatically.
- If you use a retry code (article 8) you do not pay and you do not receive an invoice.
- We may change our prices. A new price only applies to orders placed after the change.
6. Delivery
- We deliver your advice by e-mail, to the address of your order, as a PDF attachment and as a download link on your order page. The download stays available for 14 days; after that we delete the report. Please keep your own copy.
- When ordering you choose how fast you want the advice: - As soon as possible. Our colour expert checks the advices at fixed moments, morning and evening. Your advice is sent after the first check moment following your payment, plus about two hours to finish. The website shows you the concrete expected moment before you pay. - At a fixed time. We send your advice 24 hours after your payment, provided it has been approved by then.
- These moments are an expectation, not a guarantee. Sometimes it takes longer, for instance because the expert wants to look at your photos more closely. You will get an e-mail if that happens. You do not need to do anything.
- Our 36-hour promise. Has your advice not been sent within 36 hours after your payment? Then we automatically refund the full amount and also send you a free retry code. You do not have to do anything.
- A refund goes back through Mollie to the payment method you used. With iDEAL and Bancontact the money is usually back within 1 to 3 working days; with a credit card it can take up to 10 days. We e-mail you as soon as the refund has been initiated.
- If an e-mail from us does not arrive (for example because of a full mailbox or a spam filter), you can have the report re-sent from your order page for as long as it is available. A wrongly entered e-mail address is at your own risk; you can change the address yourself until payment.
7. Photos that are not paid for
If you upload photos but do not pay, we keep your photos for 3 days after your last activity so you can continue later through the link in your e-mail. After that we delete them automatically and your order lapses. If you pay after that anyway, we refund the amount and send you a retry code so you can upload again.
8. Retry code
- A retry code entitles you to one new colour advice without paying again. You receive one when our expert rejects your photos (article 9), when we miss the 36-hour promise (article 6.4) or in the situation of article 7.
- The code is bound to the e-mail address of your original order, can be used once and is valid for 90 days. The code has no cash value and cannot be exchanged for money.
- For a retry we keep the photos that were fine for at most 7 days, so you only need to retake the photos we point out. If you wait longer, you upload everything again.
- If the original order included a wardrobe check, the code covers the wardrobe check too.
9. If our expert rejects your photos
- After payment our colour expert checks whether your photos are good enough for a reliable advice. If they are not, we reject the order. You receive an e-mail with the reason.
- On rejection you receive, at the expert's choice, a retry code (with a note of which photos to retake), a full refund, or both. We always pick the solution that is most reasonable for you; if in doubt, e-mail us.
- A rejection is not a judgement about you or your appearance. It is only about whether the photos can be used for a colour measurement.
10. Right of withdrawal and starting immediately
- Our colour advice is digital content that is not supplied on a physical medium. By law you normally have a 14-day cooling-off period for such a purchase. Because we start on your advice right after payment, we ask you at checkout for your express consent to begin immediately. By giving it you waive your cooling-off period once the advice has been delivered (article 6:230p under g of the Dutch Civil Code).
- At checkout you tick this statement for that purpose:
I ask you to start my colour advice immediately and I understand that I lose my right of withdrawal (cooling-off period) once the advice has been delivered.
- Until our expert has approved your advice, you can still cancel the order from your order page. You then get the full amount back and we delete your photos immediately. After approval and delivery cancellation is no longer possible, because the advice has then been delivered.
- Without this statement we cannot accept the order; we would only be allowed to start after 14 days.
- If you are unhappy for any reason, see article 13: we are glad to sort it out.
11. Cancelling and withdrawing consent
- Before payment you can cancel your order at any time from your order page. We then delete your photos immediately.
- After payment you can cancel as long as our expert has not yet approved the advice. This also counts as withdrawing your consent for processing your photos. We delete your photos immediately and refund the full amount.
- We may refuse or cancel an order if we have a reasonable suspicion of misuse, for example photos of someone else, of a child, or use contrary to these terms. If you have already paid, we refund, unless it concerns deliberate misuse and the law allows us to set off costs.
12. Use of the advice and intellectual property
- The report is for your personal use. You may keep it, print it and share it with friends or family. You may not resell it or use it commercially without our permission.
- The layout of the report, the texts, the colour palettes and the software remain ours. The photos remain yours; we use them only to produce your advice (see the privacy policy).
- The comparison images in the report are simulations: we place colours digitally next to or over your photo. The images say so themselves.
13. Complaints
- Not happy with something? E-mail us at advies@kledingkleuradvies.nl and mention your order number. We reply within 1 working day and try to resolve your complaint within 14 days. If that is not possible within 14 days, we tell you when you can expect an answer.
- Do you feel a colour in your palette is really wrong? Let us know. Our expert then looks at your measurement again and adjusts the advice if there is reason to, at no extra cost.
- If we cannot work it out together, you can bring the dispute before the competent court in the Netherlands (article 16). This does not affect your statutory rights as a consumer, including the right to complain to supervisory authorities.
14. Liability
- We do our work carefully: the measurement is automated and calibrated with the white paper, and every advice is checked by a person. Even so, colour advice is partly a matter of taste and circumstances. We do not guarantee that every colour in the palette suits you in every situation, and we are not liable for the clothes you buy or do not buy on the basis of the advice.
- If we are nevertheless liable for damage, our liability is limited to the amount you paid for the order. This limitation does not apply if the damage results from our intent or deliberate recklessness, nor where the law does not allow a limitation.
- We are not liable for damage caused by you sharing the link to your order with others, by e-mails not arriving because of settings on your side, or by you entering a wrong e-mail address.
- Nothing in this article affects your statutory rights as a consumer.
15. Privacy
How we handle your data and your photos is described in our privacy policy. In short: your photos stay on our server for at most 36 hours and are deleted right after delivery; we never sell anything and never use your photos to train models. For the photo check and the drafting of the text we send some of your photos to our AI provider; which one and what it does with them is explained in the privacy policy.
16. Applicable law and court
- Dutch law applies to these terms and to every order.
- Disputes are brought before the competent court in the Netherlands. If you live in the EU, you may also choose the court of your own place of residence where the law gives you that right.
17. Changes
We may change these terms. Your order is governed by the terms as they were when you ordered; that version is mentioned in your confirmation e-mail. We keep earlier versions and send them to you on request.
Annex: checkout texts
These four statements appear at checkout as separate, unticked boxes. All four are required to order. For every order we record which version you accepted and when.
-
Terms
I have read the terms and conditions and agree to them.
-
Photos (explicit consent)
I give my explicit consent for my photos (face, eyes, skin, hair, wrist) to be analysed automatically and to be sent to Anthropic for that purpose; these photos may reveal information about my ethnic origin or health. I can withdraw this until delivery by cancelling my order.
-
Age
I am 16 or older and the photos are of me.
-
Start immediately (waiver of the cooling-off period)
I ask you to start my colour advice immediately and I understand that I lose my right of withdrawal (cooling-off period) once the advice has been delivered.
Directly above the pay button we also show: the name and address of Beste Prijs, the total amount including VAT, the expected delivery moment, that the advice is measured automatically and checked by a person, and how to make a complaint. The pay button shows the amount, for example "Pay € 13.95". The same information is repeated in the e-mail you receive after payment.
